Studio Hire Agreement

 

The Hirer is the person or party ultimately responsible for the payment of the hire fees set out in the invoice. The Hirer will be deemed to be aware of and have accepted these Studio Hire Terms & Conditions together with the hire fees upon any studio hire bookings and any studio items or equipment items hired at Alunara Studios. It is the Hirer’s responsibility to make themselves aware of these Studio Hire Terms & Conditions.

 

Upon confirmation by Alunara Studios of a booking request and together with any accompanying Estimate or other commercial terms agreed between the parties, the Hirer agrees to be bound by these terms and conditions. The Hirer acknowledges and agrees that they are freely entering into a legally binding agreement with Alunara Studios.

 

Booking payment

You will receive an email confirming your booking once it has been added to our calendar.

 

Bookings need to paid in full prior to the studio hire. Invoice will be issued and once paid, will secure your booking.

 

Cancellations

Cancellation of a confirmed booking less than 72 hours from the booking date (or no-shows) will result in an invoice for 100% of the issued invoice.

 

Cancellation of a confirmed booking more than 72 hours from the booking date will result in an invoice for 25% of the hire fee.

 

Cleaning

General cleaning is included in the studio hire rate

 

Studios should be left in the same condition they are found, if the studios are left in a messy condition a minimum $75 cleaning fee applies.

 

Bump in and Bump out requirements

Your booking time includes all your bump in and bump out requirements which includes set up and pack up. Please ensure you book the right amount of time.

 

Ensure you arrive on time and are packed up and are ready to leave by your scheduled finish time.

The hirer is given a 30 minute grace period. Any extra time required over your booking is charged at $60 per hour, pending availability.

 

Equipment Use

Yoga Mats, Bolsters, Blankets and Blocks are available for use as part of the hire-agreement. The use of Pilates Reformer beds comes at an additional fee of $50 per booking – unless subject to an ongoing arrangement.

 

Hire Agreement includes general use of Split System AirCon and Heating Facilities, Bluetooth enabled Sound System and Shower Facilities.

 

You must make Your own assessments regarding the fitness of the Equipment, the Studio, the Premises (as applicable) and Alunara Studios for Your particular purposes.

 

You acknowledge that Our Equipment is for professional use and is highly technical. You warrant that You understand, and where applicable will ensure that any of Your personnel who may use the Equipment understand, how to use and operate the Equipment in accordance with the manufacturer’s directions. If You are not confident operating any Equipment, Alunara Studios recommends that You use a qualified assistant.

 

Equipment must be returned to where it was obtained at the same Alunara Studios office where it was collected and must be left in the care of Our representatives. Risk in the Equipment is assumed by You from the time You (or an Authorised Person) takes possession of the Equipment until it is returned to Alunara Studios in accordance with this clause. This clause applies to all equipment rented from Alunara Studios including equipment rented for use in the studios.

Equipment must not be taken outside Australia without Our prior written consent

Insurance

 

With the exception of any of our Equipment, You must ensure that any equipment You bring to the Premises is safe to use.

You must ensure that You and Your Personnel are suitably qualified to operate Our Equipment and any other equipment You use at Alunara Studios. Alunara Studios holds no liability for loss or damage associated with Hirers Equipment or Equipment Usage.

 

Studio Availability

Our studios are available to hire 7 days a week with flexible opening and closing times. Full day hire is generally from 9am-5pm, however different hours can be negotiated dependent on availability.

Pricing for each individual studio hire arrangement is set out in individual invoices issued subject to these T&Cs.

 

Parking

The Alunara Studios has one allocated underground car park with access pass available as part of the booking.

 

Fire Alert System

Alunara Studios is connected to base building Fire Alert System. Under no circumstances are, candles, incense, or incendiary or thermal heat producing devices to be used within the studio. The hirer is responsible for any activation of the fire alert system that occurs during their hire period and associated call-out fees.

 

Sub Hire

Sub hire, paid or unpaid and including lending, is expressly forbidden without the written consent of The Alunara Studios.

Your Obligations

 

House Rules

When hiring a Studio, You warrant that You have read and will comply with, and will ensure that each of Your Personnel and guests attending the Premises reads and complies with, the House Rules. If at any time in our sole discretion We believe that You or Your Personnel or guests are being unsafe, We reserve the right to require You or Your Personnel or guests to cease the activity which we consider is unsafe, or to require that You or Your Personnel leave the Premises.

 

Damage & Loss

Use of our studio and our equipment is at HIRERS OWN RISK. Hirer hereby waives rights to seek legal redress for mishaps, accidents, and/or loss while on our premises.

 

Hirer agrees to leave the studio and adjacent grounds in the same condition as they were when Hirer arrived.

 

Hirer is solely responsible for any legal infraction Hirer or members of Hirer’s party make during the hire of the studio.

Hirer agrees to hold harmless The Alunara Studios, its owner, agents, representatives, and contractors acting on its behalf for any loss, accident, or injury to Hirer’s self or anyone who accompanies Hirer while on our premises.

 

Hirer agrees to be solely responsible for the conduct and welfare of all persons accompanying Hirer while on our premises. Hirers are solely responsible for the safety and well-being of any models Hirer engages.

 

Hirer understands that if The Alunara Studioss staff observes dangerous, pornographic, or negligent practices or activities are being engaged in The Alunara Studios reserves the right to stop the shoot and require the hirer and hirer’s party to leave immediately — HOWEVER, TheAlunara Studios assumes NO RESPONSIBILITY to act in such cases.

 

Hirer agrees to hold The Alunara Studios, its agents, representatives, and anyone acting on behalf of Hirer completely harmless from any action, legal or otherwise, that results from Hirer’s conduct. Hirers are solely responsible for verifying that all models employed during Hirer’s rental period are of legal age for the activities they are to be engaged in. The Alunara Studios has no responsibility to determine or verify the age of participants in the Hirer’s activities but reserves the right to end those activities if it becomes aware that legal age violations are on-going.

 

Hirer agrees to be responsible for, and must pay for all loss or damage caused to the Studio, the Premises or to any Equipment by You or Your Personnel or guests (reasonable wear and tear excepted). We reserve the right to charge Your credit card and/or invoice You to recover Our costs of assessment, repair and/or restoration in accordance with these Terms.

 

Indemnity & Liability

The Alunara Studios has insured the studio premises and their own equipment against all normal insurable risks but not further or otherwise. The Hirer is responsible for insuring their own equipment and personal property and that belonging to their clients, assistants, associated personnel and other third-party individuals.

 

Alunara Studios recommends that the Renter obtains sufficient insurance to cover its potential liabilities under these Terms and Conditions and holds no liability for damage or loss incurred by the Rentor and their clients or employees whilst utilising the studio.

 

The Hirer agrees to indemnify The Alunara Studios against any costs including legal costs, damages, payments, fines, or interests The Alunara Studios may incur as a result of the Hirer breaching this agreement.

 

The Alunara Studios is not liable for acts out of its control that affect the shoot, such as power outages, weather or emergencies. In such cases, The Alunara Studios may refund a prorata portion of Hirer’s payment and/or reschedule the studio booking.

The Alunara Studios reserves the right to terminate this agreement at any time with or without notice if the Hirer has breached any terms of this agreement or for unforeseeable circumstances that prevent Hirer from fulfilling the agreement.

 

This agreement remains in force for the initial and all subsequent Studio Hire sessions, unless superceded with a new agreement.
